Lindsay Lohan was booked into a California jail Tuesday to begin serving a 90-day sentence.  Sheriff's officials told the media that Lohan will serve 13 days of the 90-sentence. As a nonviolent offender, she will be released early to ease overcrowding at the state's prisons.

Two weeks ago, a superior court judge sentenced the actress to 90 days in jail, plus three additional months in rehab, for violating the terms of her DUI probation. The actress has been on probation since pleading guilty to misdemeanor drug charges and no contest to three driving charges following DUI arrests in 2007.

Lohan had her probation extended for a year in order to complete her court-mandated alcohol-education classes. Still, Lohan missed seven, and the judge based her sentence on Lohan's failure to attend the weekly classes. Lohan's defense attorney says that her client has at this point completed the classes, but the judge punished her for not completing them on a weekly basis, as her probation required.

 

Lohan also missed a hearing in May where her probation progress was to be discussed. The judge was concerned that the actress was not taking her probation or the court seriously when photos surfaced of Lohan partying at the Cannes Film Festival the night before her hearing. Lohan told the court that she missed her flight because her passport had been stolen in France.

At the rescheduled hearing, Lohan was ordered to wear an alcohol-detecting ankle bracelet. The bracelet went off while the actress was attending the MTV Movie Awards and after-parties, but the judge said she only took into consideration Lohan's failure to complete her classes when handing down her sentence.

Some of Lohan's fans have said that the sentence is too harsh, but the case's prosecutor disagreed. She said that the sentence was appropriate and that the message to the public is to refrain from driving while intoxicated and, if convicted of DUI, to complete the required probation requirements in a timely fashion.
